Kevin Spacey hides behind his cell phone and mask as he leaves Federal Court in NYC - moments after being charged in the UK for sexually assaulting three men in London and Gloucestershire

  • Kevin Spacey, 62, was spotted outside Manhattan Federal Court on Thursday where he is involved in a civil case brought by actor Anthony Rapp
  • Rapp accused  Spacey of assaulting him at a party in the 1980s when he was a teenager which House of Cards star denies
  • Thursday's court session dealt with a technical issue in the civil lawsuit by Rapp, whether it was better handled in a federal or state U.S. court
  • Spacey was earlier hit with new charges of sexual assault against three men in the UK between 2005 and 2013

Kevin Spacey was spotted at Manhattan Federal Court on Thursday moments after he was charged in a separate case of sexual assault against three men in the UK.

The 62-year-old was in court in New York testifying in a different case involving Star Trek actor Anthony Rapp.

Spacey's decorated career came to an abrupt end in 2017 when Rapp accused the star of assaulting him at a party in the 1980s, when Rapp was a teenager - which Spacey denies.

The Oscar winner on Thursday testified in the civil lawsuit filed by Rapp but did not respond to reporters as he left the courthouse.

Dressed in a grey suit and dark tie while wearing a face mask, he talked on his mobile phone as he left the building.

The new criminal charges were mentioned briefly by Rapp's lawyers during the court hearing.

Spacey's lawyers were asked about it by reporters during a break in testimony but they declined to comment.

Spacey's new charges come after a probe was launched by the Met Police in 2017.

He faces four counts of sexual assault against three men between 2005 and 2013 in London and Gloucestershire.

Spacey is also accused of 'causing a person to engage in penetrative sexual activity without consent' on one of the same three men.

The Crown Prosecution Service today revealed one man, now in his 40s, claims he was sexually assaulted twice in March 2005.

A second man, now in his 30s, claims that in August 2008 he was sexually assaulted and then forced to engage in a sex act against his will.

Finally the third complainant, now in his 30s, said he was sexually assaulted in April 2013 in Gloucestershire.

No court date has been set. The CPS said this afternoon they could not confirm if Spacey, who has homes in Britain and the US, will need to be extradited to the UK.

Thursday's court session in New York City dealt with a technical issue in the civil lawsuit, as lawyers argued whether it was better handled in a federal or state court.

Spacey was called to testify about where he lived, not about the truthfulness of the allegations against him.

Spacey testified that his main residence and domicile is in Baltimore, where he moved for the filming of 'House of Cards.'

He said he was 'beguiled by its charm, its beauty.' But he also testified about his time living in London as the artistic director of the Old Vic.

'It was extremely important to me that I endear myself to the British public, that I´m not running away,' he said, noting that his start there was troubled by a 'disastrous production' in 2005 of Arthur Miller´s last play.

Spacey said nevertheless: 'I'm an American citizen. Once the job was done, I came back to America.'

He said he made a trip to London in February 2020 for a possible film, but then the pandemic hit.

His U.S. doctor recommended that he stay there, where he resided until the following September, when his visa expired and he flew to Los Angeles for an arbitration proceeding.

Spacey said he has not been back to the UK since.

Another criminal case brought against Spacey, an indecent assault and battery charge stemming from the alleged groping of an 18-year-old man at a Nantucket resort, was dismissed by Massachusetts prosecutors in 2019.

The actor has kept a low profile in recent years. He was spotted on set in Dunsmuir, California, smoking a cigarette in July last year.

Spacey won a best supporting actor Academy Award for the 1995 film 'The Usual Suspects' and a lead actor Oscar for the 1999 movie 'American Beauty.'

In American Beauty he played Lester Burnham, an advertising executive who has a midlife crisis and becomes infatuated with his teenage daughter's best friend.

Spacey came out as gay in 2017.

He did not attend the Cannes Film Festival last week but is one of the stars of a micro-budgeted film called Peter Five Eight — in which Spacey plays a villain.

Spacey plays Peter, a 'charismatic man in a black sedan who shows up in a small mountainside community'.

He co-stars with actress Rebecca De Mornay, whom Peter targets for information at the urging of his 'shadowy' boss Lock. The film is based on a Biblical passage which runs: 'Be alert and of sober mind. Your enemy the devil prowls around like a roaring lion, looking for someone to devour.'

Spacey has denied all allegations of sexual harassment and assault.
